Terms of Use

These Terms of Use ("Terms") form a binding agreement between you and Smoovly ("Smoovly", "we", "our", or "us"), and govern your access to and use of the Smoovly mobile app and related services (the "Service"). By creating an account or otherwise using the Service, you agree to these Terms.

1. Acceptance of Terms

By downloading, installing, accessing, or using the Service, you confirm that you are at least 16 years old and that you accept these Terms and our Privacy Policy. If you do not agree, do not use the Service. If you are using the Service on behalf of an entity, you represent that you have authority to bind that entity to these Terms.

2. Description of Service

Smoovly is an AI-powered dating and relationship coaching app. The Service provides conversational AI personas, message suggestions, image analysis, and persistent memory features designed to help you communicate more effectively. The Service is provided "as is" for personal, non-commercial use. AI-generated content is suggestion-only: you are responsible for what you choose to send to anyone, and outcomes are not guaranteed.

3. Subscription and Payments

  • Apple processes all payments. Subscriptions to Smoovly Pro are sold through the Apple App Store as in-app purchases. All charges, refunds, and payment-method changes are handled by Apple under your Apple ID. Smoovly never receives or stores your payment card details.
  • Subscription length and price. Smoovly Pro is offered as a monthly auto-renewing subscription at the price displayed on the App Store at the time of purchase (currently $9.99/month in the U.S.; local pricing may differ).
  • Auto-renewal. Your subscription renews automatically each period at the then-current price unless you cancel at least 24 hours before the end of the current period. Manage or cancel your subscription anytime in your Apple ID Settings → Subscriptions.
  • Refunds. Refund requests are handled by Apple under Apple's refund policy. Smoovly cannot issue refunds directly.
  • Free tier. The free tier of Smoovly is subject to daily usage limits that may change. We will provide reasonable notice of material changes to limits or pricing.

4. User Conduct

You agree not to use the Service to:

  • Violate any applicable law or regulation, or infringe anyone's rights.
  • Harass, stalk, threaten, defame, or attempt to manipulate or deceive any person, including any individual you discuss with the AI.
  • Generate or solicit sexual content involving minors, non-consensual content, or content depicting real identifiable people in a defamatory or sexualized manner.
  • Impersonate another person or misrepresent your affiliation.
  • Reverse engineer, decompile, scrape, or attempt to extract the source code, prompts, model weights, or proprietary data of the Service.
  • Use the Service to build a competing product or to train a competing model.
  • Upload malware, attempt to disrupt the Service, or evade rate limits or access controls.

We may suspend or terminate your account at our discretion for violations of these Terms.

5. Intellectual Property

The Service, including its software, design, branding, content, AI personas, prompts, and trademarks, is owned by Smoovly and its licensors and is protected by intellectual property laws. We grant you a personal, non-exclusive, non-transferable, revocable license to use the Service in accordance with these Terms.

You retain ownership of the content you submit to the Service ("Your Content"). By submitting Your Content, you grant Smoovly a worldwide, royalty-free license to host, process, and display Your Content solely to operate, improve, and secure the Service. We do not sell Your Content or use it to train third-party models for purposes unrelated to providing the Service.

6. Disclaimers

Smoovly is a communication and coaching aid, not a substitute for professional advice. The Service does not provide medical, mental-health, legal, or financial advice, and is not a crisis or emergency service. If you are in crisis or believe someone may be in danger, contact your local emergency services.

The Service and all AI-generated content are provided "AS IS" and "AS AVAILABLE" without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, or reliability. We do not warrant that the Service will be uninterrupted, error-free, secure, or that AI outputs will be accurate or appropriate for any situation.

7. Limitation of Liability

To the maximum extent permitted by law, Smoovly and its officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, goodwill, or other intangible losses, arising from or relating to your use of the Service.

Our aggregate liability for any claim arising out of or relating to the Service or these Terms will not exceed the greater of (a) the amount you paid Smoovly (through Apple) in the 12 months preceding the event giving rise to the claim, or (b) USD $50. Some jurisdictions do not allow certain limitations of liability; in those jurisdictions, our liability will be limited to the smallest extent permitted by law.

8. Termination

You may stop using the Service and delete your account at any time from Settings → Account → Delete account, or by emailing support@smoovlyapp.com. Cancelling your Apple subscription stops future renewals but does not delete your account.

We may suspend or terminate your access to the Service at any time, with or without notice, if we believe you have violated these Terms or if we discontinue the Service. Sections that by their nature should survive termination (including Intellectual Property, Disclaimers, Limitation of Liability, and Governing Law) will survive.

9. Governing Law

These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-laws principles. You and Smoovly agree that any dispute arising out of or relating to these Terms or the Service will be resolved exclusively in the state or federal courts located in Delaware, and you consent to personal jurisdiction in those courts. Nothing in these Terms limits any non-waivable consumer rights you may have under the laws of your country of residence.

10. Changes to these Terms

We may update these Terms from time to time. Material changes will be communicated in-app or by email before taking effect. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
